Professional Malpractice
Unfortunately, many years of education and practice do not make a professional infallible. Even the best people make mistakes. Sometimes those mistakes can cause great harm to a patient or client. In those cases, a claim for Professional Malpractice may exist.
For example, if you had surgery in the last two years and something didn't go right, you may have a claim for medical malpractice against the doctor or surgeon.
If you had a Realtor and completed a short sale in the last two years and the Realtor failed to inform you of your rights under Arizona's anti-deficiency law, you may have a claim for Professional Malpractice against your Realtor.
On the other hand, if the Realtor on the other side of a deal intentionally failed to disclose a material fact or made a misrepresentation about a material fact, you may have a claim for Professional Malpractice against that Realtor.
Each profession is held to a different standard depending on their area of expertise. As a general rule, each profession's governing body provides some guidance in addition with the law.
As with any type of claim, there is a Statute of Limitations. This means that you only have a certain amount of time from when you knew or should have known about the Professional Malpractice to file and pursue your claim. If you sit back and wait, you may not be able to recover.
