August 2019 Newsletter – Unique Assets and Property

By: Lisa A. Whalen, Esq.

This month, we will be discussing the role unique assets play in a divorce or legal separation. Unique assets can range from tangible possessions such as a jewelry collection to crypto currency such as bitcoin. Unique assets can be overlooked or hidden, which makes the discovery process extremely important.

In some cases it may be necessary to hire an expert to determine the value of the asset. Once the value is determined, the parties can reach an agreement as to who will keep the asset with an equalization payment to the other party. With tangible items, this process can be straight forward. In other cases, such as those that deal with human embryos, it can become much more complex.
